General Informations:

Below you get some additional informations in short notes about the licence models, acquisition and generation process for Mikrocodesimulator MikroSim 2010 and its additonal tools. These informations should give you some help selcting your preferred licence type.

  • Independent of the state you currently using the software for demonstrating, testing, or with a valid licence - there is only one program version.
  • In whicht mode the simulator is operated is determined by the so called Product Licence File (PLF) of the software.
  • Without a valid PLF, MikroSim is working in the demo mode.
  • By copying a valid PLF into the application directory, the application is activated as unlimited version – you have the licence to use the software without any restrictions.
  • From time to time software updates are available. You can update your simulation tool without registration and licence renewal.
  • At licence acquisition, the licensee gets the software tool in most recent setup package revision available, together with his Product Licence Files on a CD-ROM via mail within Germany. Program updates are available at "www.mikrocodesimulator.de" free of charge.
  • With your valid licence you can develop or modify your microcode files, save those with you signature, distribute and reload them again with a valid licence.

Licence Models:

The simulator is availble as single-user licence or multi-user licence version:

Single-User Licence:

The single user licence is user and hardware related. After registration, the application is only unlimited usable on the dedicated system, on which the simulator has been installed, tested and the registration file (i.e. Product Licence File, PLF) is created from. The PLF contains user and hardware relevant parameter filed for the registration. This licence can only be used on that single hardware, a valid internet connection is not neccessary to operate the software.

Multi-User Licence:

A multi user licence is given to an institution, which is distributing the licences to its users for educational use. In contrast to the single user licence, the multi-user licence is not hardware or user related and needs no further registration. So, a usage of the program is possible without complicated licencing procedures. The benefit is that pupils and students can work on their own hardware if desired and are not limited to the IT equipment of the institution. Acquisition of this kind of licence is possible when ordering more than 10 licences.

Distributable Single-User Licence:

This licence type allows the usage of MikroSim as registrated version as long the USB stick is connected to the computer in use. The licence is related to the USB stick and personilized to the institution that distributes the hardware related licence to their pupils and students. They can work on their own hardware if desired and they are not limited to the IT equipment of the institution. The usage of the program is possible without complicated licencing procedures. The additional costs for the USB hardware and the efforts of distributing and collecting the hardware licence is compensated by the program tool usage without Internet connection necessary.

 

Group Licence:

Single-User, Multi-User, and distributable Single-User Licences can be used in terms of a so called Group Licence, defined by the name and institution of the licence owner. Independent which licence you are using, either Licences being computer hardware related, USB stick related and distributable, or issued as multi-user licence, the software can be used jointly among all licenced group members to exchange, open, modify, and save simulator files with the licence related signature.

Testversion:

For testing purpose, the software is distributed as demoversion. For demonstration, example files are provided to load microcode ROM and RAM contents. The example files can be modified (but not stored) and processed  in single step mode. For thorough testing purpose, the simulator can be activated for a 10 day test period without complicated registration. In case you like to activate the software for a longer period of time in your lecture for evaluation of the concept applicability, you can acquire a multi user licence at low price, which can be taken into account when ordering a personal licence. Do not hesitate to ask!


Licence Aquisition and Generation:

Single-User Licence:

After having tested the demoversion and got familiar with the software, and most probiliy having used the posibiltity to activate the unlimited 10 day test version, you can generate in the menue item „Registration“ a PLF file containg the personal data regarding licensee and institution you like to registrate with. When generating a PLF file a product code derived from hardware IDs of the computer used and the personal data is written to the file called „MikroSim_inaktiv.PLF“ or "MikroBAT_inaktiv.PLF". When ordering a licence this file is sent to 0/1-Simware to complete the registration by appending the activation code by postal or e-mail. After transfer of the licence fee an installation CD with the completed and activated PLF file is sent to the licensee. The licence is valid until no further hardware modifications are made (e.g. hard disc drive renewal, processor exchange). In case of unavoidable hardware modifications and loss of a valid licence a licence renewal is offered at moderate expenses.

Multi-User Licence:

When ordering this licence, an institution name compatible with the group licence concept needs to be declared. Based on this name an additional software is provided, which is started by entering a valid PIN code. The code generating software is delivered together with MikroSim's setup package. The registration PIN is delivered seperately. After authorization with the valid PIN, the user is able to generate PLF-Files having a validity of up to 90 days. These files needs to be distributed among the users of the software. After licence expiry, generated simulator files can still be opened, however stored and modified with a licence renewal.

For checking the licence usage, the computer have to be able to connect to the licence server operated under www.mikrocodesimulator.de via Internet connection. The licence server registrates the number of different computers, loging in per day. In case the number of ordered licences is not considerably exceeded, the programs multi-user licence is granted.

Distributabel Single-User Licence:

At licence order, for each licence a registrated USB stick with a Product-Licence-File is configurated, which is related to the USB stick hardware and the licence holder (name and institution). When ordering a larger number of USB sticks, please take delivery delays into account due to limited hardware availability.


Licence Agreement:

This license agreement is a legal agreement between you (either an individual or a legal person - called "LICENSEE") and "0/1-SimWare" ("LICENSOR") for the software product identified above, which includes computer software and associated media and may include printed materials and online or electronic documentation (hereinafter considered as “PRODUCT” or “SOFTWARE PRODUCT” or “SOFTWARE”). By installing the SOFTWARE PRODUCT, copying, or otherwise, you agree to be bound by the terms of this license agreement. If you do not agree to the terms of this license, please do not install this SOFTWARE.

SOFTWARE PRODUCT LICENSE

The SOFTWARE PRODUCT is protected by copyright laws and international treaties, as well as other laws and treaties concerning intellectual property.

1. GRANT OF LICENSE.

This license agreement grants each user of the SOFTWARE following rights:

The SOFTWARE PRODUCT is supplied as whole by the LICENSOR within an installation package, which is generally regarded as FREEWARE. You may install copies of the installation package on an unlimited number of computer, you are allowed to use it, to make backup copies, or to disclose them to third party.

This right applies not to the program parts that you obtain through acquisition of a personalized and computer-related "SINGLE SITE LICENSE AGREEMENT", or by acquisition of an institution related "MULTI-LICENSE AGREEMENT" (“CONTRACT”). The finalisation of the CONTRACT is associated by generating and delivering an encrypted product license file ("PLF"), which enables the SOFTWARE PRODUCT to activate its full functionality.

In the case the software is used without a valid PLF, it is still possible to operate the SOFTWARE as freeware. The resulting limitations are approvingly accepted by the user.

In the case of use of the software without a valid PLF, you have the possibility of activating the SOFTWARE on not personalized computers as a trial version free of costs. The unregistered user is able to determine the installation target and point in time of its ACTIVATION.

Entering the process of self-registration, any unregistered user is entitled to a LICENSEE of a temporarily valid and fully functional software installation. The automatically generated PLF grants a 10-day, computer-related, not personalised activation period of the program. After expiry of the 10-day test period, a fully activated program version can be re-established only by purchasing a single user license for that respective system or by using PLFs issued by a LICENSEE of multi-user license.

The SINGLE SITE LICENCE AGREEMENT is accepted by handing over a valid PLF file, containing computer-related and user related licence information.

The MULTI-USER LICENCE AGREEMENT is accepted by the generation, handing over or the usage of a PLF by an authorized member of the LICENSEE’S institute members to third party users, i.e. to members of a group of target users.

The use of the multi-usage capability is only possible with additional software components. These software components are subject to separate license agreements between the LICENSOR and a LICENSEE, i.e. an authorized member of an institution. The content of this ADDITIONAL LICENSE is being agreed with the installation and use of that said, in addition necessary SOFTWARE PACKAGE.

The LICENSEE of an activated TRIAL VERSION or MULTI USER LICENCE version agrees that in order to control the temporal restriction of use, the activation and operation of the software is only possible with the use of an established Internet connection to a server. Without that the software is only operable as demo version and therefore is functionally restricted. The LICENSEE agrees that the data transmitted will be judged and saved on the LICENCE SERVER in purposes of license control in the mutual interest between LICENSEE and LICENSOR. The transferred data contains not any further user or computer-specific information except of the serial number of specific hardware components, and the registered name of the Licensee.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

LIMITATIONS ON REVERSE AND DECOMPILATION.

You are not authorized to reverse-engineer the SOFTWARE PRODUCT, decompile or disassemble it. In particular, you are not entitled to alter the SOFTWARE PRODUCT in terms of its functionality, concerning in particular practices and procedures that allow overcoming software limitation implemented for controlling compliance with the license usage limits, either enabled for the user himself or for third parties.

DISTRIBUTION AND COPYING.

You are not allowed with any permission of the author to distribute the SOFTWARE PRODUCT commercially as a full version or to multiply for commercial distribution.

RENT.

You are not entitled to rent the SOFTWARE PRODUCT or lease.

TERMINATION.

Notwithstanding any other rights the LICENSOR may terminate this end user licence agreement if you fail to comply with the terms and conditions of this license.

When using a computer-related SINGLE-USER LICENSE, you are obligated as a LICENSEE in the event of contract termination, to destroy all copies of the SOFTWARE PRODUCT and all of its component parts that make it possible to operate the software product as the full version.

When using a MULTI-USER LICENSE, you are obligated as a LICENSEE in the event of termination, to destroy the copies of the SOFTWARE PRODUCT only in particular those of the ADDITIONAL SOFTWARE PACKAGES, which make it possible to operate the software product as full version with the product license files generated from this software.

The LICENSOR reserves all rights to restrict or prevent the usage of uncontrolled licenses, license violation, and over exceeding the user access limits granted. This procedure is followed by notification and warning in compliance with statutory time limits.

The LICENSOR reserves the right and the possibility of a paid LICENSE RENEWAL or EXTENSION in case of a license violation in an amicable agreement, instead of a terminating the licence. The resulting costs are borne by the LICENSEE.

DISCLOSURE OF THE SOFTWARE.

You may distribute the complete versions of the SOFTWARE PRODUCT to third parties, provided they agree to the terms of this contract. They are not allowed to charge more than a minimal fee, which shall not exceed 5.00 EURO to raise the ceiling of the cost of media, marketing and processing, or download the freeware version of the SOFTWARE PRODUCT.

Under no circumstances you are allowed use or distribute only a portion of the SOFTWARE. You must always pass a complete copy of the original SOFTWARE PRODUCT. Moreover, it is not permitted without the express written permission of the author parts of the program, to distribute apart from the PRODUCT related documentations, presentation materials or any commercially acquired PRODUCT related files from the LICENSOR. Special arrangement can always be made with the author, but require the written consent of "0/1-SimWare”.

3. UPDATES.

By ordering a SINGLE-USER LICENSE or MULTI-USER LICENSE, the LICENSEE confirms to have used the ability of a free demo version to activate and run the 10-day trial version for full compliance testing to his demands on his target system. In exceptional cases the LICENSOR reserves the right, and the possibility of a timely repair in the context of an update usable for all LICENSEE. Not functionality relevant repair requests are taken as suggestions for possible subsequent updates thereof.

The SOFTWARE PRODUCT is distributed with no right to regular updates to successful end. LICENSEE decides voluntarily to adopt a free update at their own expense.

The LICENSOR shall decide in its sole discretion, whether and when a free software update will need to issued. In the case of free software updates all expended PLF are still valid.

The recognition of a valid PLF, which is has the ability to operate the PRODUCT as a full version of the SOFTWARE, is implicitly associated with the validity of an already completed license agreement.

The LICENSOR reserves the right at any time to introduce an update not free of costs.

The LICENSOR is not obligated to provide compatibility with existing or self-generated simulation files during an upcoming update.

4. COPYRIGHT.

All title and copyrights to the SOFTWARE PRODUCT, the accompanying printed materials, and possibly all copies of the SOFTWARE PRODUCT are at "0/1-SimWare" or its suppliers. The SOFTWARE PRODUCT is protected by copyright law and international treaties.

MISCELLANEOUS.

GOVERNING LAW.

This license is subject to the laws of the Federal Republic of Germany.

NO WARRANTY.

THE SOFTWARE PRODUCT AND THE ACCOMPANYING FILES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. Due to the different hardware and software environments into which an installation of the SOFTWARE may be put, NO WARRANTY FOR THE USE OF THE SOFTWARE FOR A PARTICULAR PURPOSE IS GIVEN.

The responsible use of data processing programs requires a thorough test of the program with non-critical data before it reaches the actual use. The user of the SOFTWARE bears all risk himself.

ANY LIABILITY OF THE SELLER WILL BE LIMITED TO THE REPLACEMENT OF THE SOFTWARE OR REFUND OF PURCHASE PRICE.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW MAY “0/1-SimWare” OR ITS SUPPLIERS UNDER NO CIRCUMSTANCES FOR ANY SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OR WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION OR OTHER PECUNIARY LOSS). “0/1-SimWare” IS NEITHER RESPONSIBLE FOR THE USE OF THE SOFTWARE NOR THE INABILITY TO USE THE SOFTWARE. THIS IS TRUE EVEN IF “0/1-SimWare" PREVIOUSLY IS INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. SINCE IN SOME STATES AND JURISDICTIONS THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES ARE NOT GIVEN NOT ALL OF THE ABOVE LIMITATION MAY APPLY TO YOU.

PARTIAL VALIDITY.

In case any provision of this license agreement is regarded as wholly or partially invalid or incomplete, this has no effect on the validity of the remaining license agreement.
